These Terms & Conditions govern your use of NekaID. By creating an account or using the platform, you agree to these terms in full. Please read them carefully.
1. About NekaID
NekaID is a UK construction workforce compliance platform. It enables workers to maintain a digital passport of their credentials, allows companies to verify and manage their workforce, and allows agencies to manage labour pools and placements.
NekaID is operated by Lyuben Metodiev trading as NekaID, based in the United Kingdom. Website: nekaid.co.uk. Contact: info@nekaid.co.uk.
2. Eligibility
To use NekaID you must:
- Be 18 years of age or older.
- Be based in the United Kingdom.
- If registering as a worker, have the legal right to work in the UK.
- Use the platform for legitimate workforce management, compliance, or construction site administration purposes.
3. Account types and responsibilities
Workers
Workers are responsible for the accuracy and completeness of all information entered into their NekaID passport, including but not limited to: name, trade, CSCS card details, National Insurance number, bank details, passport photo, right to work document, and qualification information.
Workers must keep their details up to date, particularly expiry dates for CSCS cards, right to work documents, and qualifications.
Workers are responsible for choosing who to share their QR code or passport link with. Sharing your passport link with a company or agency grants that party access to the data permitted for their access tier. Do not share your passport link with any party you do not wish to share your data with.
Companies
Companies and site managers are responsible for verifying that workers are suitable, qualified, and legally permitted to work on their sites. NekaID provides credential information to support this process but does not replace a company's legal verification duties.
CSCS card details and qualifications are self-declared by workers unless explicitly marked as verified by NekaID. Companies must carry out their own verification checks as required by law.
Site GPS coordinates and attendance data are provided for operational convenience only. NekaID does not guarantee their accuracy or suitability for legal compliance purposes.
Agencies
Agencies are responsible for handling worker data — including bank details, National Insurance numbers, passport photos, and right to work documents — in full compliance with UK GDPR, the Data Protection Act 2018, and all applicable employment and payroll law.
Agencies must not use worker data for any purpose other than workforce management, payroll administration, and placement activity.
4. Sensitive data responsibility
Workers acknowledge that entering sensitive data into their passport — including bank details, National Insurance number, passport photo, and right to work documents — makes this information visible to agency accounts they share their passport with.
Workers are solely responsible for deciding who to share their passport with. NekaID provides access controls but cannot prevent misuse of data once a worker has chosen to share their passport link with a third party.
5. Verification disclaimer
CSCS card details, qualification information, and uploaded documents are self-declared by workers unless a record is explicitly marked as verified by NekaID. NekaID does not independently verify the authenticity, validity, or completeness of any worker-submitted credentials.
Companies and agencies must carry out their own credential verification, Right to Work checks, CSCS checks, and any other compliance checks required by law before permitting workers to access sites or commence employment.
6. Data sharing
Workers control access to their data by choosing whether to share their QR code or passport link. Once a worker shares their passport with a company or agency, that party can view the data permitted for their access tier until the worker requests deletion of their account.
NekaID does not sell, rent, or share worker personal data with any third party other than the data processors listed in our Privacy Policy and parties the worker has explicitly chosen to share with.
7. GPS and site attendance
Site sign-in on NekaID is manual. Sign-out may be automated via GPS geofence (650-metre radius from the registered site location). GPS data is used solely for attendance tracking purposes and is not used for any other form of monitoring.
NekaID is not liable for GPS inaccuracies, missed sign-outs, incorrect attendance records, or any consequences arising from reliance on attendance data for legal or payroll purposes.
8. Messaging
In-app messages, photos, and PDFs sent via NekaID messaging are stored on our servers and are accessible to both the sender and recipient. Do not send sensitive personal data via messages beyond information already contained in your passport profile.
NekaID may access message content where required for security investigations, legal compliance, or to resolve disputes.
9. Prohibited use
You must not use NekaID to:
- Engage in any illegal activity or facilitate the illegal activities of others.
- Impersonate another person or company.
- Upload false, forged, or misleading documents or credentials.
- Access, view, or misuse personal data belonging to other workers.
- Use automated scripts, bots, or scrapers to extract data from the platform.
- Interfere with the security, integrity, or operation of the platform.
- Share personal data without a proper legal basis or the consent of the individual concerned.
10. Payments and subscriptions
Company and agency accounts are subject to subscription fees. A 14-day free trial is available on all plans. A valid payment card is required at the start of the trial. No charge is made during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your card will be charged.
Payments are processed securely by Stripe. NekaID does not store payment card details. All prices are in GBP and are exclusive of VAT. NekaID is not VAT registered.
You may cancel your subscription at any time via the billing portal. Cancellation takes effect at the end of the current billing period. NekaID does not offer refunds on partial billing periods.
We may update pricing, features, or plan limits as the service develops. Material changes to pricing will be notified in advance.
11. Intellectual property
The NekaID platform, branding, design, software, and code are owned by Lyuben Metodiev trading as NekaID. You must not copy, reproduce, resell, reverse engineer, or misuse any part of the platform without written permission.
Workers retain ownership of their own personal data and uploaded documents. By using NekaID, workers grant us a limited licence to store and display their data solely for the purpose of providing the platform features they have requested.
12. Limitation of liability
To the maximum extent permitted by law, NekaID is not liable for:
- Credential verification failures or reliance on self-declared worker information.
- GPS inaccuracies or errors in attendance records.
- Third-party misuse of worker data after a worker has shared their passport link.
- Loss or corruption of data due to third-party infrastructure failure (including Supabase, Vercel, or Resend).
- Business losses, compliance failures, or site access decisions made by companies or agencies based on NekaID data.
13. Termination
NekaID may suspend or terminate any account that breaches these Terms, presents a security risk, or is used for fraudulent or unlawful purposes.
Workers may delete their account at any time via the platform. On deletion, personal data is removed in accordance with our Privacy Policy.
14. Governing law
These Terms & Conditions are governed by the laws of England and Wales. Any disputes arising from your use of NekaID will be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Changes to these Terms
We may update these Terms & Conditions as NekaID develops. Material changes will be notified by email to all registered users. Continued use of the platform after notification constitutes acceptance of the updated Terms.
